Terms & Conditions The Luxury Floor

These general terms and conditions apply to every appointment, treatment, purchase and agreement between The Luxury Floor, located at Staatsbaan 94, 3620 Neerharen (Lanaken), Belgium, company registration number 1030.834.440, and the client.

By booking an appointment, whether by phone, email, via the website, social media or any other means, the client confirms having read and agreed to these general terms and conditions.

1. General
These general terms and conditions apply to all offers, treatments, product sales and other services provided by The Luxury Floor.

Deviations from these terms are only valid if agreed in writing in advance.

Should one or more provisions be found wholly or partly invalid or unenforceable, the remaining provisions shall remain in full force.

2. Treatments
The Luxury Floor carries out every treatment to the best of its knowledge, skill and in accordance with the professional standards applicable within the industry.

Each treatment is tailored to the client’s natural eyebrows, facial features and wishes. Results may vary from person to person and depend, among other things, on skin and hair condition, previous treatments, medication use, hormonal influences and adherence to aftercare instructions.

The Luxury Floor therefore cannot guarantee a specific aesthetic result.

3. Medical information & contraindications
The client is required to provide, prior to each treatment, all information that may be relevant to the safe performance of the treatment.

This includes, among other things:
* allergies;
* previous allergic reactions to hair dye or cosmetic products;
* pregnancy or breastfeeding;
* medication use;
* skin conditions or infections;
* recent cosmetic or medical treatments;
* other medical conditions that may affect the treatment.

If it becomes apparent during the consultation that a treatment cannot be safely carried out, The Luxury Floor reserves the right to refuse, postpone or adjust the treatment.

If a treatment cannot take place because relevant information was not provided by the client in advance, the reserved treatment time may be charged.

4. Allergies & patch test
Although The Luxury Floor works exclusively with high-quality professional products and in accordance with applicable hygiene guidelines, allergic or other unexpected physical reactions can never be fully ruled out.

Clients with a known allergy to hair dye, colorants or other cosmetic ingredients must report this before the treatment.

If desired, or if The Luxury Floor deems it necessary, a patch test can be carried out at least 48 hours before the treatment.

An unexpected allergic or physical reaction does not in itself entitle the client to a refund for a treatment.

5. Appointments
Appointments can be made via the website, by phone, by email or via social media.

An appointment is final once confirmed by The Luxury Floor.

Clients are requested to arrive on time.

If a client arrives late, The Luxury Floor reserves the right to shorten the treatment time in order to avoid delays for subsequent appointments. The full price of the reserved treatment remains payable in that case.

If the available time is insufficient to carry out the treatment properly, The Luxury Floor may decide to reschedule the appointment. In that case, the cancellation terms may also apply.

6. Cancellations & no-shows
An appointment can be changed or cancelled free of charge up to 24 hours before the scheduled appointment.

In the event of cancellation within 24 hours of the appointment, or in the event of a no-show without notice, The Luxury Floor reserves the right to charge the full cost of the reserved treatment.

This fee is due because the reserved treatment time can generally no longer be allocated to another client.

If the vacated appointment slot can still be filled in full, The Luxury Floor reserves the right to waive the cancellation fee in whole or in part.

If a treatment cannot be carried out because the client failed to disclose essential information regarding medical conditions, allergies or contraindications in advance, the full reserved treatment time may also be charged.

7. Prices & payment
All listed prices are in euros and include statutory VAT.

The Luxury Floor reserves the right to change prices. A price change does not affect appointments already confirmed.

Payment is due immediately after the treatment, via the accepted payment methods.

Products remain the property of The Luxury Floor until paid in full.

8. Personal data & privacy
For the safe and careful performance of treatments, The Luxury Floor processes the client’s personal data.

This data is used exclusively for scheduling and carrying out appointments, maintaining treatment records, administrative purposes and complying with legal obligations.

Personal data is handled carefully and confidentially in accordance with the General Data Protection Regulation (GDPR) and applicable Belgian privacy legislation.

Personal data is not sold or provided to third parties, unless necessary for the performance of the agreement, legally required, or the client has given explicit consent.

9. Confidentiality
All information provided by a client during a treatment is treated confidentially.

This information is used exclusively for the safe and professional performance of the treatment.

Only where a legal obligation exists may The Luxury Floor be required to provide certain information to competent authorities.

10. Liability
The Luxury Floor carries out every treatment with the utmost care and in accordance with applicable professional standards.

The Luxury Floor is not liable for damage resulting from:
* incorrect, incomplete or withheld information provided by the client;
* failure to follow the aftercare advice provided;
* an unforeseen allergic or physical reaction that is not the result of an error or negligence on the part of The Luxury Floor;
* normal or expected reactions that may occur with a cosmetic treatment.

The Luxury Floor is likewise not liable for the loss, theft or damage of personal belongings brought by the client to the salon.

Nothing in these general terms and conditions limits or excludes The Luxury Floor’s liability to the extent this is not permitted under Belgian law.

11. Aftercare
For an optimal result, it is important that the client carefully follows the aftercare instructions provided.

The final result and durability of a treatment are also influenced by factors beyond The Luxury Floor’s control, such as skin type, hair growth, hormonal changes, medication use and home care.

If the aftercare advice is not followed, The Luxury Floor cannot be held liable for a diminished result or reduced durability of the treatment.

12. Products
The Luxury Floor works exclusively with professional products.

For hygiene reasons, opened or used products cannot be exchanged or returned, unless a statutory right applies or a demonstrable manufacturing defect exists.

Unopened products can only be returned if they are in their original, unused and resalable condition.

13. Complaints
If a client has a complaint about a treatment or a product, it must be reported to The Luxury Floor in writing as soon as possible, and no later than within five working days of discovery.

The Luxury Floor will carefully investigate every complaint and respond substantively within a reasonable period.

If a complaint proves to be justified, The Luxury Floor will make every effort to reach a suitable solution together with the client.

14. Gift vouchers
Gift vouchers can only be used for treatments and/or products at The Luxury Floor and cannot be exchanged for cash.

Gift vouchers are valid for 2 years from the date of issue, unless stated otherwise.

In the event of loss, theft, damage or unauthorized use, The Luxury Floor cannot replace or reimburse the gift voucher.

If an appointment booked with a gift voucher is not cancelled in time, or the client fails to show up without notice, the cancellation terms also apply. In that case, the value of the reserved treatment may be deducted from the gift voucher.

15. Photos
Photos of treatments are only taken and used with the client’s prior consent.

The photos are used exclusively for the purposes for which consent was given, such as The Luxury Floor’s website or social media.

The client may withdraw this consent at any time for future use.

16. Force majeure
The Luxury Floor is not liable for the failure to carry out a treatment, or for not carrying it out on time, if this is the result of force majeure.

Force majeure includes, among other things: illness, accidents, technical failures, power outages, fire, extreme weather conditions, government measures, or other circumstances beyond The Luxury Floor’s reasonable control.

In the event of force majeure, the appointment will be rescheduled in consultation as soon as possible.

17. Applicable law
Belgian law exclusively applies to all agreements between The Luxury Floor and the client.

The parties will make every effort to first resolve any disputes through mutual consultation.

If this proves impossible, disputes will be submitted to the competent court in accordance with Belgian legislation.
